Terms & Conditions
By purchasing a ticket to a Dance Beyond (“DB”) program (hereinafter referred to as the “Program” or “Programs”), you (the “Participant”) acknowledge and agree to be legally bound by the following Terms and Conditions:
1.0 Participation Agreement
Dance Beyond is committed to offering experiences in conscious dance and communal living. Participation in any DB Program is conditional upon acceptance of all terms stated herein. If you do not agree to these Terms & Conditions, you may not participate in any DB Program.
1.1 Cancellation & Refunds
All ticket sales are final and non-refundable. No refunds or exchanges will be provided for any reason, including but not limited to Participant illness, scheduling conflicts, travel issues, or dissatisfaction with the Program. DB strongly recommends that Participants purchase travel insurance that includes trip cancellation coverage.
1.2 Assumption of Risk & Waiver of Liability
By participating in the Program, Participant acknowledges and agrees that:
• Participation is voluntary and may include physical activities such as dancing, hiking, and outdoor living.
• The Program involves inherent risks, including but not limited to physical injury, illness (including communicable diseases such as COVID-19), allergic reactions, weather-related incidents, interactions with wildlife or insects, equipment failure, and the acts or omissions of other participants or third parties.
• Participant knowingly and voluntarily assumes all risks, both known and unknown, and agrees to participate at their own risk.
Release: Participant hereby waives, releases, and discharges DB, its officers, directors, employees, agents, volunteers, and affiliates from any and all claims for personal injury, death, property damage, or other loss, except to the extent caused by DB’s gross negligence or willful misconduct.
1.3 Participant Responsibility & Health Acknowledgment
Participants must ensure they are physically and mentally fit to participate in the Program. DB reserves the right, at its sole discretion, to deny participation or remove any Participant from the Program whose health or behavior is deemed disruptive, dangerous, or detrimental to the group or the experience. Such removal shall be at the Participant’s sole expense, and no refunds shall be issued.
Participants are responsible for bringing any necessary medications and disclosing any significant medical conditions or allergies in advance. DB is not responsible for providing medical care.
1.4 Code of Conduct & Dismissal Policy
Participants are expected to treat others with respect, care, and integrity. Dance Beyond reserves the right to deny or revoke participation at any time, without refund, due to behavior deemed disruptive, disrespectful, unsafe, or in violation of community values, including harassment, theft, or use of illegal substances.
1.5 Medical Consent & Emergency Costs
In the event of a medical emergency, Participant authorizes Dance Beyond staff or emergency personnel to secure and provide necessary medical treatment, including hospitalization. Participant acknowledges full responsibility for any medical expenses incurred and agrees to hold Dance Beyond harmless for any such costs.
1.6 Changes to Itinerary / Program Cancellation
DB reserves the right to make changes to the Program’s schedule, location, content, facilitators, or itinerary as needed, due to operational, safety, legal, or other concerns. If the Program is canceled by DB for any reason, DB’s liability shall be limited to a refund of any payments received, minus non-recoverable costs. DB is not liable for any travel, lodging, or incidental expenses incurred by the Participant.
1.7 Limitation of Liability & Indemnification
To the fullest extent permitted by law:
• DB shall not be liable for any indirect, incidental, consequential, or punitive damages.
• DB is not responsible for the acts or omissions of third-party vendors, service providers, or independent contractors.
Third-Party Providers: DB may engage third-party vendors, including but not limited to security personnel, facilitators, and transportation providers. Participant agrees that DB is not responsible for the actions or omissions of these independent contractors and waives all claims related thereto.
Participant agrees to indemnify, defend, and hold harmless DB and its affiliates from any and all claims, losses, liabilities, or expenses (including attorneys’ fees) arising out of or in connection with their participation in the Program.
1.8 Personal Property Disclaimer
Dance Beyond is not responsible for any lost, stolen, or damaged personal belongings. Participants are advised to secure their valuables and bring only what they are comfortable keeping with them at all times.
1.9 Force Majeure
DB shall not be responsible for delays, damages, or cancellations caused by events beyond its control including, but not limited to: natural disasters, pandemic, epidemic, acts of terrorism, war, government restrictions, labor disputes, power failures, or transportation issues. In such events, no refunds will be issued, and DB may provide credit toward future Programs, at its sole discretion.
1.10 Media Release
By participating in a DB Program, Participant grants DB the right to record, photograph, and use their image, voice, or likeness for promotional purposes without compensation. Participants who do not wish to be photographed or recorded must notify DB in writing prior to the start of the Program.
1.11 Governing Law & Dispute Resolution (U.S. & International)
These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States, and, where applicable, the laws of the state in which the specific Program takes place, or the jurisdiction in which Dance Beyond is organized or primarily operates, without regard to conflict of law principles.
Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these Terms, participation in any Dance Beyond Program, or the relationship between the Participant and Dance Beyond, whether occurring in the U.S. or internationally, shall be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association (AAA) or the International Centre for Dispute Resolution (ICDR), an international division of AAA.
Unless otherwise mutually agreed, arbitration shall take place virtually or in a neutral location reasonably convenient for both parties. All proceedings shall be conducted in English. The arbitrator’s decision shall be final and binding and may be entered in any court of competent jurisdiction.
Participants agree to waive any right to a trial by jury or to participate in a class action or collective arbitration. Dance Beyond shall not be liable for the laws, regulations, or conditions of foreign jurisdictions where Programs may take place, and participation is undertaken at the Participant’s own risk.
1.12 Entire Agreement & Severability
These Terms constitute the entire agreement between the Participant and DB. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment
By purchasing a ticket and participating in a DB Program, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
